Holdover tenant
A tenant who stays in the unit after their lease has ended, without the landlord agreeing to a new term.
A holdover tenant is one who remains in the rental after the lease expires without signing a renewal. What happens next depends on the landlord’s response and the law: accepting rent may create a new month-to-month tenancy, while refusing it may set up an action to recover possession.
Holdover situations are governed by state and local rules covering notice, whether the tenancy converts, and sometimes “holdover” rent for the overstayed period. Removing a tenant who won’t leave still requires the lawful eviction process, never self-help.
